Lewis Hall is available to play for Newcastle against his parent club, Chelsea, in the Carabao Cup on Tuesday night.
The 19-year-old midfielder turned left-back joined Newcastle this summer on a season-long loan but with a £34million obligation to buy included in the deal.
That clause will be activated based on appearances and other performance-related factors, but has yet to be met.
Newcastle have secured special dispensation to play the Cobham academy graduate against Chelsea despite him being ruled ineligible to play against the Blues in the Toon's 4-1 win at St. James' Park in the Premier League.
Hall, who scored in the 3-0 win at Manchester United in the last round, made 12 appearances for the Blues before his summer exit.
Chelsea and Newcastle agreed on the deal to allow Hall to move at the ownership level in late August, securing the late arrangement to help ease Financial Fair Play (FFP) issues.
For Chelsea, the deal was simply about raising funds after spending £1billion across the last three transfer windows, with academy graduates counting as 'pure profit' on the club accounts.
Meanwhile, Newcastle couldn't afford a deal up front and chose to spread the cost by making the transfer permanent next season.
