ChatGPT violates copyright when it scrapes content from subscribers, ANI tells HC

ChatGPT has been infringing on ANI’s copyright by taking content directly from its website as well as scraping content shared with ANI subscribers, the news agency told the Delhi High Court on Tuesday, according to Bar and Bench.

The court was hearing ANI’s copyright infringement suit against OpenAI, which developed and owns ChatGPT.

The submission was reportedly made before Justice Amit Bansal by the news agency’s counsel advocate Sidhant Kumar, who referred to an article from the Economic Times which has subscribed to use ANI’s content for a fee. Kumar argued that taking this content would also mean an infringement of ANI’s content.

Senior advocate Amit Sibal, appearing for OpenAI, argued that a copyright infringement claim will not apply when the same facts are narrated by different persons, according to Bar and Bench. To cite an example, he reportedly pointed out that a quote given by a celebrity and published across media portals would not carry copyright. He reportedly said that ChatGPT only provides a summary of what is available online in its own words and redirects users to the websites from which the information is sourced from.

However, Kumar said that while copyright may not lie in common facts, the manner in which such facts are narrated does carry a copyright.

The matter will be heard next on March 28.
