Luigi Mangione: UnitedHealthcare CEO’s suspected killer faces federal charges after waiving extradition

Luigi Mangione faces federal charges over the killing of UnitedHealthcare CEO Brian Thompson, according to newly unsealed court documents.

The charges include murder through use of a firearm, two stalking charges and a firearms offense, according to multiple outlets. The 26-year-old has also been hit with charges in New York at a state level, which include murder as an act of terrorism.

Mangione was arraigned on Thursday after he formally waived his right to an extradition hearing in Pennsylvania and was immediately returned to the Empire State.

The suspected gunman is accused of fatally shooting the healthcare executive on the streets of Midtown Manhattan on the morning of December 4 and then eluding police for five days before he was arrested at a McDonald’s in Pennsylvania.

High-profile attorney Karen Friedman Agnifilo has recently been retained to defend him. Agnifilo previously worked at the Manhattan District Attorney’s Office, serving as the chief assistant district attorney for seven years, before moving to private practice in 2021.

Mangione’s supporters continue to donate thousands of dollars to his “defense” fund. The anonymous fund, “December 4th Legal Committee”, has amassed more than $140,000 in donations on the crowdfunding website GiveSendGo.

Luigi Mangione has retained a top New York attorney for his legal defense in connection with the shooting of UnitedHealthcare CEO Brian Thompson.

The Independent understands that Karen Friedman Agnifilo has been officially retained to represent Mangione, 26, in New York, after the executive, 50, was gunned down outside the New York Hilton in Midtown Manhattan on 4 December.

Following a massive week-long manhunt, the shooting suspect was arrested after being seen eating a meal inside a McDonald’s in Altoona, Pennsylvania, on Monday morning, with an employee calling the tip into police.

Brian Thompson was laid to rest at a private funeral service in his Minnesota hometown on December 9.

“These are the threats of a lawless, violent mob who would trade in their own vigilantism for the rule of law that protects us all,” she said Tuesday.

New York Governor Kathy Hochul is expected to issue a warrant for Luigi Mangione’s extradition to New York after a grand jury indictment unveiled murder and weapons charges against the suspected killer of United Healthcare CEO Brian Thompson.

He is due in court in Pennsylvani on Thursday.

Mangione was arraigned last Monday in Pennsylvania on felony counts of forgery and carrying a firearm without a license, as well as three misdemeanors: tampering with records or identification, possessing instruments of crime and providing false identification to law enforcement.

On Tuesday, Manhattan prosecutors charged him with three murder counts and eight weapons charges.

Set with the task of tracking down a fugitive from the law, you can guarantee social media will track them down in record time – even if the only thing to go by is a small, three-inch gap between a mask and a hood. Prosecutors announced on Tuesday that Luigi Mangione had been charged with murder “as an act of terrorism.”

A New York law passed after the September 11 attacks allows prosecutors to charge crimes as acts of terrorism when they're “intended to intimidate or coerce a civilian population, influence the policies of a unit of government by intimidation or coercion and affect the conduct of a unit of government by murder, assassination or kidnapping.”

Prosecutors have applied the statute to various contexts. Some related to international extremism, but the law was first used against a Bronx gang member after a hail of gunfire killed a 10-year-old girl and paralyzed a man outside a christening party in 2002. The state's highest court later said the conduct didn’t amount to terrorism, and a retrial produced convictions on other charges.

Manhattan District Attorney Alvin Bragg noted that the killing of UnitedHealthcare CEO Brian Thompson happened early on a workday in an area frequented by commuters, businesspeople and tourists.

CNN reporter Danny Freeman, who was present in the courtroom, said the 26-year-old’s behaviour was very different to previous appearances. Mangione has made small outbursts when arriving and inside the court at previous hearings.

“He seemed calm during much of this hearing,” Freeman said, adding that throughout much of the proceedings Mangione had been sitting by himself “just waiting.”

“He was smiling at times... He was chatting at times with some of the sheriff’s deputies as well, but mostly keeping his head down, reading and writing on some of the papers that he had in front of him.

The plane returning Luigi Mangione to New York has landed on Long Island, according to reports and flight trackers.

Mangione is expected to be transferred to a NYPD helicopter, which will take him to Manhattan, CNN reported.

Luigi Mangione’s attorney, Karen Agnifilo, said that the decision to add federal charges on top of state-level charges was “highly unusual.”

“The federal government’s reported decision to pile on top of an already overcharged first-degree murder and state terror case is highly unusual and raises serious constitutional and statutory double jeopardy concerns,” Agnifilo said in a statement shared with The Independent.

“We are ready to fight these charges in whatever court they are brought.”

Diddy lawyer Marc Agnifilo spotted at Manhattan court ahead of Mangione arraignment

High profile defense attorney Marc Agnifilo was seen alongside his wife Karen Friedman Agnifilo – who is representing Luigi Mangione – at the Manhattan courthouse where the 26-year-old is soon to be arraigned on federal murder charges.

The two attorneys were seen walking together into the Daniel Patrick Moynihan courthouse on Thursday afternoon, according to CNN.

The court is also where Sean “Diddy” Combs faces multiple federal charges of sex trafficking and racketeering conspiracy. Marc Agnifilo is defending the rapper and music mogul.

Mangione’s arraignment is due to take place at around 2.30 p.m.

Eric Adams ‘leading from the front’ by escorting Mangione

New York City Mayor Eric Adams said he had intended to demonstrate he was “leading from the front” by being part of the escort of Luigi Mangione to federal court in Manhattan on Thursday.

The mayor, who is himself facing federal criminal charges of corruption, condemned Mangione’s actions as an act of terrorism and the violence” that would “not be tolerated in the city.” “We wanted to personally be here to show the symbolism of leading from the front,” Adams told reporters after the escort.

He also described the support for Mangione and his actions as “vile” and “sends the wrong message.”

“You’re celebrating using violence to solve an issue,” he said. “A person that uses a gun to solve a concern – if it’s on a school campus or on our streets – there are mechanisms in this country for how to organize around those issues of concern... You don’t use a gun.”

Mangione’s attorneys will not seek bail — for now

Inside a federal courtroom in Manhattan, prosecutors have asked a judge to keep Luigi Mangione in jail while facing charges for the killing of UnitedHealthcare CEO Brian Thompson.

Mangione’s attorneys said they will not seek bail at this time.

Magistrate Judge Katharine Parker presided over his brief appearance.

Mangione answered “yes” twice when asked by the judge whether he understands his rights and has seen the federal complaint against him.
