Attorneys for Boston Marathon bomber Dzhokhar Tsarnaev are seeking to remove the judge overseeing the protracted legal battle over Tsarnaev's death sentence. During a hearing in federal court in Boston, Tsarnaev's lawyers argued that U.S. District Court Judge George O’Toole should be recused from the case due to comments he allegedly made about the case on podcasts and at public events.
Prosecutors expressed their lack of opposition to a hearing on the recusal request, deeming the motion meritless. Judge O’Toole scheduled a hearing on the matter for next month, emphasizing the need to address it promptly.
Furthermore, O'Toole mandated that all future filings related to the case be done under seal to safeguard the integrity of the process. A victim of the bombing, Mikey Borgard, who suffered hearing loss and post-traumatic stress disorder in the 2013 attack, attended the hearing and shared his perspective on the ongoing legal proceedings.
In March, a federal appeals court directed O'Toole to investigate claims of juror bias and determine the validity of Tsarnaev's death sentence following his conviction for his role in the bombing that claimed three lives and injured hundreds. The U.S. Supreme Court reinstated Tsarnaev's death sentence in 2022 after the 1st Circuit had previously overturned it in 2020.
