BMW driver admits causing death of 34-year-old 'much-loved mam' after smashing into tree in County Durham

A BMW driver has admitted causing the death of a "much-loved mam" after smashing into a tree near Newton Aycliffe.

Stephen Matthew Smith was behind the wheel of the car when it veered off the road and collided with a tree on Middridge Road shortly after 6pm on Friday, October 9, 2020. His passenger, Kayley Robinson, 34, was airlifted to James Cook Hospital in Middlesbrough following the crash but died as a result of her injuries on October 14.

Smith, of Scarth Walk, Stockton, was subsequently arrested and charged with causing death by dangerous driving and appeared at Durham Crown Court on Wednesday where he pleaded guilty to the single charge. The 39-year-old, who requires a wheelchair, appeared at the hearing via link.

Tony Davis, defending Smith, said there had been a delay in the matter coming to court and indicated the tragic incident may have occurred as the result of the "speed" Smith was driving at and the "bumpy road surface" at the time. He said that a pre-sentence report would have to prepared as well as a medical report regarding Smith's condition, before he is sentenced.

Recorder Jamie Hill QC told Smith that the sentencing would be adjourned until September and will be heard by the Recorder of Durham, Judge James Adkin. He said he would be given credit for his guilty plea. Recorder Hill QC added: "A custodial sentence for an offence of this seriousness is inevitable. You must prepare yourself for a custodial sentence."

Smith was granted bail until his next court appearance and he will be sentenced on Friday, September 23 - full details of the offence will be opened on that date. He will appear for sentencing via link from Teesside Magistrates' Court and an interim driving ban was also imposed.

Following her death, Ms Robinson's family paid an emotional tribute to her, they said: "Kayley was a much-loved mam, daughter, little sister and auntie. A one of a kind that left a lasting impression on anyone she met and she’ll be eternally missed by so many."
