Bearsden dog walker banned from running animal business from flat amid noise row

A woman has vowed to fight a ban on running her dog walking business from her flat.

Lindsey Weir cares for pooches and also offers a boarding service for dogs when their owners are away.

Her business, Lindsey's Happy Dawgs, operates from her apartment in Bearsden. But she was hit with a notice ordering her to stop her services following a complaint about noise.

East Dunbartonshire Council said a 'material change' in the use of her flat had occurred without planning permission.

They also said 'increased' noise from dogs boarding at the flat would disrupt her neighbours.

Weir, who spent time in the armed forces, has now launched an appeal against the ruling and has received support from neighbours and customers of her dog walking services.

In her written letter to the government, she said: "I am not causing any noise or disruption to my neighbours, the complainant doesn't live in my block and is in the block next to mine.

"There is no noise from my dogs in the communal areas as I have trained them not to bark.

"I collect dogs for dog walking from owners houses and not in my flat as claimed and boarding dogs don't cause disturbance to my neighbours."

Offering her support, Heather Harris told how she left her dog Harris with Weir regularly and has experienced no issues.

She said: "We consider we are very lucky to have Lindsey and if we were to no longer have Lindsey's service, it would be a great stress to us and, I believe, to Harris."

Gail Anderson added: "Lindsey is extremely reliable and takes her dog business very seriously and we would be extremely lost without her services."

Neighbour Robert Cadzow said: "She told me that a complaint had been made to your department by someone who is not a neighbour but who lives elsewhere and that the nature of the complaint was that her dogs were noisy and caused a disturbance.

"To say I was surprised would be an understatement, I can say categorically that in my opinion her dogs are not noisy and do not cause a disturbance."

Issuing their notice, the council said: "The planning harm associated with the breach of planning control is the general disruption caused by the operations of the business on neighbouring residents, including increased noise from dogs at the property during the day and more importantly during the night.

"As the property is within a block of flats any disruption caused by the business is particularly apparent."

A government reporter will issue a decision in due course.
