Attorney Argues For Dismissal Of Charges In Election Subversion Case

Former U.S. President Trump holds presser after criminal case hearing on porn star hush money charges in New York

An attorney representing one of the alleged fake electors in Georgia has presented arguments seeking the dismissal of charges in the election subversion case. The attorney, Craig Gillen, is representing David Shafer, the former chair of the Georgia Republican Party accused of acting as a fake elector in the 2020 election.

Gillen disputed the claim in the indictment that Shafer was not a 'duly' appointed elector. He argued that during the time when Shafer and others allegedly submitted a false document declaring Trump's victory in Georgia, there were no duly elected and qualified presidential electors from the state.

Furthermore, Gillen contended that Shafer and the other co-conspirators were acting based on legal advice. In a court filing, Gillen stated that Shafer was attempting to comply with the guidance of legal counsel and adhere to the laws governing the electoral count when submitting the purportedly fake document.

Additionally, Gillen asserted that Shafer did not function as a 'public officer' as claimed in the indictment. He also challenged the accusation of forgery concerning Shafer's signing of the elector document.

The arguments put forth by Gillen shed light on the defense strategy employed in the case, emphasizing legal interpretations and the intent behind the actions of the accused individuals. The court will ultimately determine the validity of these arguments as the legal proceedings unfold.
