The current Manhattan District Attorney has announced plans to retry Harvey Weinstein following the overturning of his sexual assault conviction. One key question that arises is whether Amber Gutierrez, a supporting witness in the case, will be involved in the retrial. However, it has been confirmed that Gutierrez will not be participating in the upcoming trial.

Amber Gutierrez expressed her satisfaction with the decision to retry the case. She had previously testified in Los Angeles as a supporting witness. The New York Court of Appeals cited the inclusion of testimonies from multiple women, including Gutierrez, as a reason for overturning Weinstein's conviction. The court deemed that these testimonies did not directly relate to the charges brought against Weinstein.

Amber Gutierrez is part of a network of accusers and survivors of sexual assault who are advocating for changes in laws related to such cases. They believe it is crucial for juries to consider patterns of alleged behavior when evaluating such cases.

It is worth noting that Amber Gutierrez is still bound by a nondisclosure agreement (NDA). Despite this, she chose to break the million-dollar NDA to provide insights in an interview regarding the case.
