Alleged home attacker 'laughed at partner's distress', court told

A man choked his partner eight times and indecently assaulted the woman while "laughing at [her] distress", court documents have alleged.

The 42-year-old accused attacker, who is not named to protect the alleged victim's identity, was granted bail in the ACT Magistrates Court on Monday.

He did not enter pleas to choking, committing an aggravated act of indecency and aggravated common assault before being ordered to stay out of the ACT.

In police documents read to the court, the man is accused of returning home intoxicated in the early hours of Sunday morning.

He allegedly found his on-and-off partner of a decade in a bedroom and pulled her into the lounge room, where he is said to have violently grabbed her wrists and ripped her top.

According to the documents, he placed his hands around the woman's neck to the point where she could not breathe. This is said to have occured eight times.

The man then allegedly indecently assaulted his partner by forcefully touching her breasts and trying to place his hands down her pants.

The alleged crimes are said to have only stopped because the woman's daughter came into the room.

Police were eventually called and arrested the man.

In expressing concerns to police about her partner being released into the community on conditional release, the alleged victim said she had felt unable to escape during the incident due to the pair's size difference.

"[The man's] not really acting in a way that's conscious of the impact of his behaviour on other people," magistrate Alexandra Burt said, noting five others, including children, were in the house.

"That really says something about your client's state of mind."

Ms Burt said she was also concerned about allegations of unreported assaults at the home.

But ultimately, the magistrate said she was satisfied the man could follow "strict bail conditions".

They included that he left the territory by midnight on Monday and abstained from drinking alcohol.
